How to File a DMCA Takedown Notice

Send a written notice to our designated copyright agent. To be valid under the DMCA, the notice must include all of the following:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work claimed to have been infringed.
  3. Identification of the material that you claim is infringing, with information sufficient to allow us to locate it on the Site (URL is best).
  4. Your name, postal address, telephone number, and email address.
  5. A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner.

Counter-Notice

If you believe your content was removed or disabled by mistake or misidentification, you may submit a counter-notice. The counter-notice must include your physical or electronic signature, identification of the removed material and where it appeared on the Site before removal, a statement under penalty of perjury that you have a good-faith belief the material was removed in error, your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, and that you will accept service of process from the original complainant.

Repeat Infringers

It is the policy of DialHelpUSA, in appropriate circumstances and at our sole discretion, to disable or terminate the accounts of users or contributors who repeatedly infringe copyrights or violate our policies.

Misrepresentation

The DMCA imposes liability for damages, including costs and attorneys' fees, on any person who knowingly materially misrepresents that content is infringing or was removed in error. Please consult with an attorney before submitting a notice or counter-notice if you have any doubt.
